Each WaInsight “Account” is unique and is determined by a combination of email and mobile phone number information that must correspond to a natural person. An Account permits access to the selected digital bundle of services related to the WaInsight Platform. An Account must therefore be private to a person. The Account created provides a link to the relevant WaInsight Services (the “Services”) referred to below.

Each Account is linked to a dedicated virtual namespace, which users can think of as their personal workspace.

An Account is the permitted modality via which a WaInsight user (the “Account Holder”) can consume, view, contribute to and otherwise analyse compare and contrast:

1. quantitative Place Quality Measures (as defined below), concerning the economic, social demographic, built environment and natural capital characteristics and information in respect of any given postcode;
2. qualitative Place Quality Measures (as defined below), being, place-related video, audio and user generated opinion content;
3. macro or micro past, present and predicted and residential property “Market Data”

(1. and 2. together constitute “Place Quality Measure(s)”, whilst 1., 2. and 3., together constitute “Data Service(s)”).

In order to obtain a valid Account an Account Holder user must agree to be bound by and adhere to, the (1) Terms & Conditions; (2) Acceptable Use Policy; (3) Privacy Policy; (4) Cookie Policy; (5) Community Participation Policy and (6) Licensing Terms as found at Walulel’s website’s legal section. Such consent is deemed by signing-up to WaInsight and providing the personal information required.

The “Subscription” associated with an Account is how Account Holders pay for WaInsight. An Account Holder will only need a subscription if signed up for one of WaInsight’s paid packages. An Account Holder can choose between a monthly or annual subscription. Subscriptions auto-renew, but An Account Holder can cancel at any time. Any cancellation will be enacted at the end of the subscription period applicable to the Package purchased.

An Account Holder must select a “Package” as part of a subscription. The Package lets Walulel know how much to charge the Account Holder each billing period. WaInsight currently has one free plan (WaInsight Gratis) and four paid package options: (1) Pro S; (2) Pro M; (3) Pro L; and (4) Expert. Each Package entitles the Account Holder (and if applicable their permitted assigns) a unique service consumption quota in respect of a permitted range and and quantum of Geospatial Data Service consumption.

An Account Holder must select a Package as part of a subscription. The Package lets Walulel know how much to charge the Account Holder each billing period. WaInsight currently has one free plan (WaInsight Gratis) and four paid package options: (1) Pro S; (2) Pro M; (3) Pro L; and (4) Expert. Each Package entitles the Account Holder (and if applicable their permitted assigns) a unique service consumption quota in respect of a permitted range and and quantum of Geospatial Data Service consumption.

It is worth noting that all invoices in respect of WaInsight are ultimately £GBP. Invoices are currently payable in other currencies but will be settled in £GBP or the alternative currency equivalent at the rates determined by the payment provider.

Refunds and return policies are not required by law for software services such as those provided to Account Holders. All payment obligations are non-cancellable and all amounts paid are non-refundable.

The Place Quality Measures and Market Data provided to an Account Holder is provided by us in good faith, and before being made available for use by Account Holders for their own ends, all due care skill and attention taken to maintain the veracity, currency and utility value of the Place Quality Measure and Market Data together with any other accompanying information that has been processed and/or analysed by us (or our associates Walulel associates).

Notwithstanding the above, the Place Quality Measures and Market Data are for informational purposes only and should not be used or construed as an offer to sell, a solicitation of an offer to buy, or an endorsement, recommendation or sponsorship of any real estate parcel, real estate security, or real estate interest by Walulel, its associates, officers, directors, employees or agents. By using the Data Services, all Account Holders continuingly acknowledge and agree that neither the Place Quality Measures and/or Market Data is intended to supply investment or financial advice. Neither WaInsight nor Walulel offers any advice regarding the nature, potential value, or suitability of any particular real estate parcel, real estate security, or real estate interest, transaction, investment or investment strategy. all Account Holders continuingly acknowledge and agree that the use of the Place Quality Measures and/or Market Data, and any decisions made in reliance upon the Place Quality Measures and/or Market Data, are made at the Account Holder’s own risk, unless express written consent to the contrary is provided by at least two natural persons, capable of binding Walulel to such an Agreement.

For an Account Holder to consume the Data Services as part of the Geospatial Data Service(s) Enhanced Geospatial Data Service(s) WaInsight provides, Account Holders are advised:

In respect of “Inbound Data”, being data any user generated content files, such files:

• must abide the content delivery guidelines (as advised where appropriate within WaInsight)
• must abide the minimum and maximum content quota guidelines (as advised where appropriate within WaInsight)
• must abide the content style guidelines (as advised where appropriate within WaInsight)
• must abide the content typology guidelines (as advised where appropriate within WaInsight)
• must abide the content reference guidelines (as advised where appropriate within WaInsight)
• must abide the content delivery guidelines (as advised where appropriate within WaInsight) content reference guidelines(as advised where appropriate within WaInsight)

Exporting Data: Log Sessions

In respect of “Outbound Data”, being data any user mandate export content files, such files:

• must abide the content conveyance guidelines (as advised where appropriate within WaInsight)
• must abide the content sharing guidelines (as advised where appropriate within WaInsight)

With a WaInsight paid Account (i.e. Pro S; Pro M; Pro L; or Expert), the Account Holder will be eligible to consume WaInsight’s “Enhanced Geospatial Data Service(s)” which consists of digital Data Services that inform in respect of the the place quality of any postcode within an “Urban Jurisdiction” we serve, such as (1) London, (2) Accra, (3) Birmingham, (4) Manchester, (5) Nairobi, (6) Dar-es-Salaam, (7) Lagos, (8) Abidjan, (9), Cairo, (10) Paris, (11) Berlin, or (12) Johannesburg (as available from time to time), with access to the following named features:

• Walulel Data - Over 1000 proprietary and professionally processed place-quality measures (each a “Dataset”) to enable the subjective and objective: observation; analysis; comparison; prediction; contrasting; and opinion-distillation (“Contextual Understanding”).
• My Data - User Generated Datasets in respect of which an Account Holder can make use of WaInsight’s applicable computational algorithms to undertake observation; analysis; comparison; prediction; contrasting; and opinion-distillation on data proprietary to the Account Holder and/or Walulel Data.
• Market Insight - Economic monitoring and communication tooling to enable the Account Holder to:
  (a) market property to and communicate with free users of WaInsight’s Geospatial Data Service(s);
  (b) provide Community Participation Policy compliant subjective place based insight to free users of WaInsight’s Geospatial Data Service(s); and
  (c) derive aggregated trends about an Urban Jurisdiction in respect of the localised property market preferences, performance, activity and press content.
• Basket Report - Dynamic reporting and exporting tooling to enable an Account Holder to save, export or share accessed content for later use.

With a WaInsight free Account (i.e. Gratis), the Account Holder will be eligible to consume WaInsight’s “Geospatial Data Service(s)” which consists of digital Data Services that inform in respect of the the place quality of any postcode within an “Urban Jurisdiction” we serve, such as (1) London, (2) Accra, (3) Birmingham, (4) Manchester, (5) Nairobi, (6) Dar-es-Salaam, (7) Lagos, (8) Abidjan, (9), Cairo, (10) Paris, (11) Berlin, or (12) Johannesburg (as available from time to time), with access to the following named features:

• Walulel Data (with tethering restrictions) - Over 1000 proprietary and professionally processed place-quality measures (each a “Dataset”) to enable the subjective and objective: observation; analysis; comparison; prediction; contrasting; and opinion-distillation (“Contextual Understanding”) - with restrictions imposed on the reasoning utility and permitted consumption capacity.
• Walulel Data (with brokerage capabilities) - Gratis Account Holder controlled - access to Enhanced Geospatial Data Service(s) Account Holders’ subjective place based insight and marketed property.
